There appear to be no other alternative uses of the <br />property. <br />Urn <br />•/ • <br />The building envelope for this lot with standard <br />setbacks of the LR-IB zoning district is sufficient to <br />develop a residence and the ordinary driveways and <br />appurtenant improvements while still meeting hardcover <br />requirements. <br />6. The City Council has considered this application <br />including the findings and recommendations of the <br />Planning Commission, reports by City staff, comments by <br />the owner and the effect of the proposed variance on <br />the health, safety and welfare of the community- <br /># <br />, 7. The City Council finds that the conditions existing <br />on this property are peculiar to it and do not apply <br />generally to other property in this zoning district: <br />that granting the variance would not adversely affect <br />traffic conditions, light, air nor pose a fire hazard <br />or other danger to neighboring property; would not <br />merely serve as a convenience to the owner, but is <br />necessary to alleviate a demonstrable hardship or dif <br />ficulty; is necessary to preserve a substantial <br />property right of the owner; and would be in keeping <br />with the spirit and intent of the Zoning Code and <br />Comprehendi>/e Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council <br />hereby grants a variance to Municipal Zoning Code Section 10.24, <br />Subdivision 5 (B) to approve the construction of a residence on a <br />substandard lot of area 17,030 square feet where 43,560 square <br />feet of area is required, and a lot width of 100 feet where a lot <br />width of 140 feet is required, subject to the following <br />conditions: <br />1. Payment of $225.00 sewer unit charge with the building <br />permit. <br />2. Dedication of the platted portions of County Road 19. <br />3. No setback or hardcover variances will be granted. <br />Maximum hardcover on the lot to be 5,109 square feet or less <br />including buildings, driveways, patios, decks, etc. <br />• # <br />A <br />r V <br />a- ■■ <br />Page 2 of 4
