Mr <br />Kamm is proposing to split off the northerly portion of his lot and is <br />purchasing 0.284 acres from Mr. Mithun to gain enough acreage to meet <br />requirements and to be able to access directly onto North Ferndale. <br />Both proposed lots with existing homes have suitable alternate <br />drainfield sites. Testing for the proposed new building lot has been <br />submitted and indicates ample areas of suitable soils exist for standard <br />trench drainfield systems at primary and alternate sites. <br />The designation of setback areas on this plat is somewhat perplexing. <br />If you go by the locations of the various roadways, both Kamm and Mithun <br />have corner lots, which would then designate the line between the backsides <br />of the two existing houses as defining side yards rather than the rear <br />yard designation if house orientation was the determining factor. This <br />discussion is academic except that Mr. Shanedling directly west of the new <br />building lot, has concerns about a house being located so close to his <br />property. I feel there is justification based on the orientation of the <br />houses to go with a 50' rear setback along the Shanedling/Kamm line, by <br />designating that line as being "opposite the front lot line" (which is the <br />75* stretch along N. There appears to be ample site distance at the <br />location if the driveway entrance is kept as far north as possible. <br />Suoject to a final designation on the setback requirements, staff <br />would recommend approval of the proposed division, finding that adequate <br />setbacks are maintained to the existing homes, that each new or existing <br />• ft>
