s' <br />TO: Mayor and City Council <br />FROM: Mark Bernhacdson, City Administrate <br />DATE: December 2, 1985 <br />SUBJECT: Ulrich Property, 1535 Bohn's Point Road <br />Jeanne Mabusth and Toro Jacobs met with the project manager and <br />contractor for the subject property on Wednesday, November 27th. <br />At that meeting they discussed their intended landscape plans and <br />conditional use permit. In addition to outlining the permit fees <br />and work that needs to be done prior to the next consideration by <br />the Planning Commission on this matter, it was indicated to these <br />individuals that should any further landscaping work be done <br />which has not been expressly approved by the staff in advance of <br />the work being done will result in a citation to the parties <br />involved. <br />HEIGHT OF j3UILDING - Having reviewed the applicable ordinances <br />together with the site it is our opinion that the height of the <br />building as constructed is legal and under our codes had the <br />house had a different design that conformed to the original <br />contours they could have resulted in a structure that was 4 to 6 <br />feet higher than the one being constructed. The facts of the <br />situation as it relates to this house are as follows; <br />- Basement - Constructed at 933. total 12 foot height. <br />” Grade and Original Building Envelope - Presently <br />investigating the amount of fill that was possibly done <br />on the site prior to issuance of the original foundation <br />permits back in July of 1985. Based on the estimates <br />this filling would have possibly raised the site a <br />maximum of 2 feet. Although not possessing original <br />contours for the site we are av;are that the site <br />originally had a ridge that ran through part of it, and <br />in fact, the original topography in one area where the <br />house is going in was at least 6 feet above what will be <br />the finished grade for the house. On the other hand <br />there was extensive moving of soils from one area to <br />fill-in in the other area to flatten out the site. <br />Within the purview of the code this is considered normal <br />and usual grading of the site under the exception <br />allowed in section 10.03 subdivision 21. This site <br />modification is within the bounds of site modifications <br />done in several other areas including: <br />1145 VJyndmere Road - <br />11C5 Wyndmere Road - <br />1180 Wyndmere Road - <br />3229 Casco Circle B <br />Jackson <br />Hong <br />Kim <br />- Swanson <br />- Height of Building - Both our zoning code and the <br />Uniform Building Code address determination of building <br />height.
