He is in agreement with the engineer s report. <br />It was moved by Nolan, seconded by Smith, to recommend approval of Application #1844 for <br />Ken Hopkins. 65/75 Eemdale Green, subject to five conditions as outlined by the City Engineer <br />and f.--ther recommendation regarding the slope, seeding and the use of a fiber blanket. Vote. <br />Ayes 4, nays 0. <br />Hopkins reported there is a dangerous situation in pulling out of Ferndale Gieen onto Ferndale <br />Road because of low trees hanging onto the road. <br />(#4) #1847 MICHAEL AND D.ANA H.\RRETT >UsT) JAMES .AND MOLLY WHEELER, <br />2912/2918 CASCO POINT ROAD - SUBDIVISION OF A LOT LINE <br />REARlUVNGEMEiNT - PLTILIC HEARING 7:58 TO 8:13 P..VI. <br />The Affidavit of Publication and Certificate ot Mailing were noted. <br />.Michael Barrett and .Mark Greene, an attorney representing Universal Title Insurance, were <br />present. <br />Mabusth explained that in 1983 the property owners completed a lot rearrangement without ^e <br />anDroval of the City which provided for an 8 ’4" setback to the new division Ime. The City did <br />not have an oppormnity to review it. The City would have asked for a 10’ setbacic ^ <br />comer of the residence. The owners are asked to consider the issue at this time. Universal Title <br />Insurance Company has hired Mark Green to complete the lot line rearrangements. <br />Greene slated this is to remedy a discrepancy between the legal de-scripiions that ap^ar on the <br />Ceriiticates of Title for the properties, tax records and City records. A fence has existed <br />between the properties for some time, 'ihe purpose is not to create any new lot but just to <br />cham-e the configuratiims to coin.id. at the City and County. The parcel was split off before <br />the City actually approved it. <br />Chair Schroeder suggested 10’ problem be corrected. He had spoken to Wheeler who had <br />seemed supportive of 3ltcriii§ the line. <br />Greene said Wheeler was rather reticent to granting the additional change.
