A RESOLUTION GRANTING AN AFTER-THE-FACT VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 <br />FILE NO. 1829 <br />WHEREAS, Diane Sieff (hereinafter "the applicant") is the owner of the property <br />located at 1080 Wildhurst Trail within the City of Orono and legally described as follows: <br />Lots 5 and 6, Tonkaview Gardens, Hennepin County, Minnesota (hereinafter "the <br />property"); and <br />WHEREAS, the applicant has applied to the City for an after-the-fact variance <br />to Municipal Zoning Code Section 10.22, Subdivision 2 to permit the reconstruction of decks <br />and a deck expansion of 8 ’ x 20’ at the north side of the residence where 7,500 s.f. or 39.5% <br />hardcover exists and where 7,265.9 s.f. or 38.2% is proposed and where 25% is allowed. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1829. <br />2, The property is located in the LR-IB Lakeshore Residential Zoning District <br />rec]uiring one acre in area. The property consists of 28,5(X) s.f. or .65 acres. <br />3 The Orono Council reviewed this application at their September 13, 1993 meeting <br />and recomniended ct'nceptual approval ul the alter-the-lact variance application <br />based upon the following findings; <br />A. Total hardcover on the property has been reduced from 28.1% to 27%. <br />D. Applicant has proposed total removal of hardcover within the 0-75 ’ <br />setback area. <br />C. All structures cither remodeled or expanded .meet required setbacks. <br />U only variance sought by applicant is for hardcover excesses within tl^ <br />75-250 ’ setback area. <br />Page 1 of 5
