ORDINANCE if , 2ND SERIES <br />AN OKDPiANCE TO REPEAL ORDINANCE NO. 116, SECOND SERIES AND <br />/VMEND SECTION 9.34 ADOP1EI) APRIL 1, 1984 ENTITLED "FIRE PROTECTION <br />AND PREVENTION." <br />The City Council of Orono ordains: <br />SECTION 1. Ordinance No. 116, Second Series adopted June 14. 1993 is hereby repealed. <br />SECTION 2. Municipal Code Section 9.34 as adopted April 1, 1984 and entitled 'Tire <br />Protection and Prevention" is hereby reinstated in its entirety. <br />SECTION 3. Municipal Code Section 9.34. Subdivision 2 (A) (2) is hereby deleted and the <br />following language substituted in its place: <br />2. Aboveground Tank Locations. In those districts not included in <br />Item 1 above, the storage of flammable or combustible liquids in aboveground tanks is <br />pennitted provided such tanks are located in conformance with MUFC Sections 79.501 <br />and 79.1001, and with the following: <br />(a) No such tank shall be located in any required front yard <br />space as defined in the Zoning Chapter. <br />(b) No such tank shall be located within 50 feet of any side or <br />rear propeny line unless it has a minimum one hour fire rating. A tank with a minimum <br />one hour fire rating may be located within 30 feet of any side or rear property line. <br />(c) No such tank shall be located within 75 feet of any lake, <br />wetland, stream or drainageway unless such tank is diked in accordance with MUFC <br />Section 79.508. 'Hie minimum setback for a diked tank shall be 30 feet from the lake, <br />wetland, stream or drainageway. <br />SECTION 4.
