Zoning File ^1864 <br />September 15, 1993 <br />Page 4 <br />Description of Request <br />The applicant proposes the complete reconstruction of a new caretaker residence to <br />replace existing structure built in the ’40s originally as a lakeshorc cabin. Structure is located <br />approximately 50 ’ from the shoreline. The new structure will be located 100’. Note grade level <br />patio is allowed within 75-100 ’ of the shoreline of Tanager Lake. 24 acres of dry buildable area <br />will .support four residential units on property (zoning district requiring a minimum of 2 acres <br />per one residential unit). Footprint of the new caretaker unit is reduced by 350 s.f. Access to <br />this property can be gained from Millston Road just to the east of the Jacob’s driveway. Access <br />can also be gained from the Jacob’s property at the most northern garage. <br />Review Fxhibit F, Weekman notes that the existing septic system that serves the <br />residence is very old and there is no record of a permit ever being issued for the installation of <br />the system. It will be necessary to provide new septic testing for both principal and alternate <br />sites upon application for the building permit. <br />There will be a reduction of some 360 s.f. of total accessory structures on the property <br />with the construction of the new caretaker house. Although there is a reduction, it will be <br />necessary to address new variances as we are dealing with new construction. <br />Issues for Consideration <br />1, The ordinance dealing with oversized accessory structures does not consider or <br />address special needs of an estate use. Should there be limits on the number of <br />oversized accessory structures? Note that the conditional use permit for <br />guesthouse or caretaker use requires that structures be located so that appropriate <br />area and setbacks are met to satisfy standards of zoning district in case of future <br />subdivision. Other nonhabital accessory structures are controlled by the specific <br />covenants set forth in the code in the case of future subdivision. <br />2. Other issues raised by Planning Commission. <br />Planning Commission Members may refer to the former approval resolutions for the <br />statement of hardship and unique findings. Tlie folUwing conditions are recommended by staff: <br />1.Applicant shall be responsible for providing septic testing for a principal and <br />alternate septic treatment area to serve the new residence. <br />As with all conditional use permits dealing with guesthouse or caretaker u.se. your <br />appn>val must include the disclaimer that the unit can never be used for rental <br />purposes while the parcel is still legally combined with the larger homestead <br />parcel. <br />ch
