serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicartt; and jvould be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />5.The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City suff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Baaed upon one or more of the findings noted above, the Orono City Council <br />hereby grains variances to Municipal Zoning Code Section 10.03, Subdhisioo 9 (C-2) to permit <br />the construction of a 60 x 80’ indoor riding arena that will exceed the allowed foot prim area <br />for a single ovenized accessory structure and will result in an excess of total area for accessory <br />structures subject to the following conditions: <br />Per Section 10.27 Subd. 3a (10.20 Subd. 3m) 10 acre property shall be limited <br />to the keeping of 7 horses. <br />2.Riding arena must meet the following setbacks; 75’ from both side lot lines and <br />100 ’ from the rear lot line. Applicant shall provide an updated survey locaiini <br />all existit^ and proposed accessory structures on property upon application for <br />building permit. <br />3.Applicant shall execute "City of Orono Covenant for Oversized Accessory <br />Structure" Uial shall control the existence of the structure should the properly be <br />consideted for subdivision at some future time. <br />Authorities granted by this variance run with the property not with the appUcant. <br />but are permissive only and must be exercised by application for a buildi^ <br />permit within one year of the date of Council approval, or this variance will <br />expire on that date (September 27, 1994). <br />VioUtion of or non^winplianPe with any terms and of ths <br />Page 3 of 5
