Gary Petersen's Request for a Variance on Lots 184 and <br />Part of Lot 185, Taylor's Subdivision of Spring Park Lots <br />Dear Council Member: <br />I represent Mr. P. Gary Petersen, who has submitted an application <br />for a variance on the above described property in the City of Orono. Tlie <br />property is located on Ivy Place in Casco Point. Enclosed please find a <br />copy of a plat depicting the location of the property. <br />Mr. Petersen acquired the property in 1976 frcaa the estate of <br />Arthur P. Bendel with the intention of building his home on the property. <br />Mr. Bendel has owned the property since 1958. The property was platted <br />in 1885 as Lot 184 of Taylor's Subdivision of Spring Park Lots and was <br />in compliance with ail zoning and platting laws at the time it was platted. <br />The Village of Orono subsequently aerepted and approved the plat. <br />Of the 13 lots in this subdivision, Mr. Petersen's property is <br />the largest. The other*12 lots range in size from 10,400 square feet to <br />12,500 square feet. Mr. Petersen's property measures 14,271 square feet <br />on the plat. All other lots in the subdivision have houses erected on <br />them. Only Mr. Petersen's property is undeveloped. <br />The property has been assessed for sewer and water and the follow <br />ing special assessments remain unpaid: $225.00 sewer plant charge; $375.00 <br />SAC charge sewer and water; and $250.00 park dedication fee. All special <br />assessments will be paid if Mr. Petersen is granted authority to build on <br />i:he property. <br />The only zoning requirement from which a variance is sought is <br />the area and width requirement. Mr. Petersen's proposed dwelling will <br />comply with all other requirements of the zoning code; e.g. setback and <br />use requirements. Enclosed please find a survey of the property which <br />includes a sketch of the dxvelling and the position of the lake and alley. <br />You will notice that the travelled portion of the alley encroaches on <br />Mr. Petersen's property. This alley was inspected by Allen Olsen.
