1 <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO _________________ <br />c/ <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 1 (B) AM) SUBDIVISION 2 <br />FILE NO. 1841 <br />WHEREAS, William G. and Lori ComeUus (hereinafter "the applicants") are <br />owners of the property located at 960 Tonkawa Road within the City of Orono (hereinafter "the <br />City") and legally described as follows: <br />refer to Exhibit A enclosed, (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for variances to Municip^ <br />Zoning Code Section 10.22, Subdivisions 1 (B) and 2 to permit a section of a former roaabed <br />located within the la:<:eshore protected area to remain and to be upgraded as ^ <br />drivewav The former gravel roadbed is located 50’ from the lakeshore where a 75 setb <br />would be required and will result in 1200 s.f. of permanent hardcover where no hardcover is <br />allowed. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono. <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1841. <br />2. <br />3. <br />The property is located in the LR-IB Lakeshore Residential Zoning District <br />requiring one acre in area. The subject property consists of 2.8 acres. <br />The Orono Planmng Commission reviewed this application on July 19, 1993 and <br />recommended approval of the proposed variances based upon the following <br />findings: <br />A. Applicant and applicant’s contractor were not notified by surveyor ^at <br />loop driveway approved with building permit was relocated out of the 75 <br />setback area without any consideration of the impact on existing elevations <br />nor on mature trees. <br />Pace 1 of 6
