In the early planning <br />stages of the new facility based on budget constraints, Council determined that portions of the <br />subject property would be offered for sale for residential development. The sale of the property <br />has been advertised in the paper and the City has accepted a bid from a potential buyer for the <br />single residential lot. The following ordinances are pertinent for this review: <br />1. Chapter 11, Class 3 Subdivision <br />2. Section 10.28, Subdivision 5 (B), RR-IB Rural Residential Standards <br />3. Section 10.56, Shoreland Regulations - Natural Environment Lake <br />Total area = 36.7 acres <br />13.7 acres dry land <br />Lot 1 = total of 4.66 acres (.16 part of French Lake) <br />Note wetland areas (adjacent to French Lake at east side of lot) have not <br />been designated <br />Outlot A = 32.04 acres. <br />List of Exhibits <br />A - Plat Map <br />B - Property Owners List <br />C - Certificate of Mailing <br />D - S & P Testing Report <br />E - As-built <br />F - Detail of Proposed Residential Lot <br />G - Preliminary Plat <br />The undeveloped property is currently served by a gravel drive that was regularly <br />maintained by the City when the outdoor storage yard was in use. The City’s use of the <br />property for open yard storage has been discontinued. The existing drive will provide access <br />to the future residential lot. Based on earlier discussions with the Public Works Director it is <br />not clear whether the City will maintain the road while there is no active use proposed for Outlot <br />A. The MWCC will provide maintenance when access to the facility is needed. The issue of <br />regular maintenance of road must be resolved between future property owner and City. There <br />is a 20’ wide access easement throughout Outlot A granted in favor of the MWCC. This has <br />been shown on the preliminary plat survey.
