CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the Orono City Council <br />hereby grants variances to Municipal Zoning Code Section 10.22, Subdivisions 1 (B) and 2 to <br />allow a section of gravel drive to remain located 50 ’ from the shoreline requiring a 25’ or 33% <br />setback variance and 1200 s.f. or 2.66% hardcover surface where no such hardcover is allowed, <br />subject to the following conditions: <br />1. <br />3. <br />4. <br />5. <br />All road improvements within the 12’ wide drive located within the lakeshore <br />protected area shall be limited to the e.xisting roadbed as the City will approve no <br />expansions of drive within the lakeshore protected area. <br />Prior to the installation of the drive, the City Engineer must approve the driveway <br />and final drainage plans for site. <br />Authorities granted by this resolution run with the property not with the <br />applicants, but are permissive only and must be exercised by application for a <br />building permit within one year of the date of Council approval, or this variance <br />will expire on that date (August 9, 1994). <br />Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />The undersigned applicants have read, understood and hereby agree to the terms <br />of this resolution and on behalf of themselves, their heirs, successors and assigns, <br />hereby acree to the recording of this resolution in the Chain of Title of the <br />property. <br />Page 3 of 6 <br />..1
