A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 1 (B) AND SUBDIVISION 2 <br />FILE NO. 1841 <br />WHEREAS, William G. and Lori Cornelius (hereinafter "the applicants") are <br />owners of the propert>' located at 960 Tonkawa Road within the City of Orono (hereinafter "the <br />City") and legally described as follows: <br />refer to Exhibit A enclosed, (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for varnnces to Municipal <br />Zoning Code Section 10.22, Subdivisions 1 (B) and 2 to permit a section c a former roadbed <br />located within the lakeshore protected area to remain and to be upgraded as part of a loop <br />driveway. The former gravel roadbea is located 50 ’ from the lakeshore where a 75 ’ setback <br />would be required and will result in 1200 s.f. of permanent hardcover where no hardcover is <br />allowed. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />1. <br />3. <br />FLNDINGS <br />This application was reviewed as Zoning File #1841. <br />The property is located in the LR-IB Lakeshore Residential Zoning District <br />requiring one acre in area. The subject property consists of 2.8 acres. <br />The Orono Planning Commission reviewed this application on July 19, 1993 ;md <br />recommended approval ot the proposed variances based upon the ^ollo^■/ing <br />findings: <br />A. Applicant and applicant’s contractor were not notified by surveyor that <br />loop driveway approved with building permit was relocated out of the 75 ’ <br />setback area without any consideration of the impact on e.xisting e.evations <br />nor on mature trees. <br />Page 1 of 6
