ADDENDUM TO PURCHASE AGREEMENT <br />DATED JULY 1993 <br />BETWEEN ROBERT L. MELAMED AND ELIZABETH MELAMED <br />OR THEIR ASSIGNS, BUYER, <br />AND CITY OF ORONO, SELLER <br />1. Leyal Description. Attached as Exhibit "A" is a surveyor’s sketch which <br />generally shows the boundaries and size of the property. The exact boundaries, size and <br />legal description shall be set forth in a survey to be prepared by a registered land surveyor <br />and provided at Seller’s expense. The exact boundaries shall be jBxed by mutual <br />agreement between Seller and Buyer. <br />2. Purchase Price. The purchase price shall be the sum of ' <br />payable as follows: <br />S 50,000 earnest money as hereinbefore set forth; <br />$ 50,000 additional earnest money to be paid upon acceptance by Seller <br />of this Purchase Agreement; <br />the balance to be paid in cash on date of closing. <br />3. Date of Closing. Subject to the satisfaction of all conditions of this Purchase <br />Agreement, the closing shall take place at the offices of Abdo and Abdo, PA^ 710 <br />Nortbstar West, 625 Marquette Avenue, Minneapolis, Minnesota 55402, at 10:00 o’clock <br />a.m. on Tuesday, October 5, 1993, or at such later time as the panies mutually agree. <br />4. Real Estate Commissions. Seller and Buyer acknowledge that neither has <br />retained or agreed to pay a commission or finder’s fee in connection with the sale of the <br />property and each shall indemnify the other from any claims therefor as a result of the <br />other’s actions. <br />5. Sewer Connections. Buyer shall be obligated to pay for the cost of <br />connection to the sewer system including the installation of a sewer stub or stubs, <br />connection to any home, sewer access charges and city connection charges. <br />6. Representations and Warranties of Seller. Seller makes the following <br />representations and warranties to Buyer (in addition to those contained in the preprinted <br />Purchase Agreement), which shall be true at the time of closing as if such representations <br />were made at such time. All such representations, warranties and other agreements made <br />by Seller shall survive the closing and any investigation at any time made by or on behalf <br />of Buyer.
