Vs <br />6"* <br />July 19, 1993 <br />Revision to Time Frame for Repair of Nonconforming Septic Systems <br />List of Exhibits <br />A - Proposed Revision <br />B - Fxisting Code E.xcerpts <br />On July 12th Council voted unanimously to extend the one year repair period for <br />nonconforming systems to two years. The proposed language in E.xhibit A accomplishes this <br />with a number of caveats which staff recommends. These include: <br />1.Only those systems which are nonconforming solely due to lack of water table <br />separation would be granted the time extension. Tliose systems which are <br />nonconforming due to other factors (failing, discharging, cesspools, outhouses, <br />etc.) would still be required to meet the one year rtandard as in the past. <br />The extended lime period takes into consideri lion the many potential times of <br />year that a nonconformity might be identified and allows two full construction <br />seasons (typically May through November) for the necessary upgrades. For <br />systems identified as nonconforming late in the year, they would have just over <br />two years to make repairs. Systems identified early in the year (April through <br />June) would actually have two and a half years. Staff feels tliis is necessar>- since <br />many of the newly identified noncontorming systems will need to be replaced <br />with mounds, which can only be installed when the soil moisture content is below <br />ihe plastic limit. In some years, when rains come often enough that the ground <br />rarely dries out, there are few opportunities for mound installation and contractor <br />scheduling can be a big problem. <br />After reading the minutes and listening to the tape of the July 1-ih meeting, a few <br />questions were raised which may be answered by the following comments: <br />A.By design, the Shoreland Regulations refer back to the septic ordinance in Section <br />12.30 for virtually all construction standards except setbacks from the lake. <br />Because Chapter 12 is inunicipal code but not the zoning code, it can be amended <br />without the standard zoning code public hearing procedures.
