TO:Mayor and City Council <br />FROM:Ron Moorse, City Administrator <br />July 23, 1993 <br />SUBJECT: Sewer Plant Property Sale <br />DATE: <br />\ <br />6' <br />\ <br />5$^ <br />% <br />*oIn response to an ad placed in the Minneapolis Star Triune on <br />Saturday, July 17 and Sunday, July 18 and letters sent to property <br />owners adjacent to the sewer plant property the City received two <br />bids for the purchase of the property. The advertisement indicated <br />bids would be accepted until 4:00 p.m. on Thursday, July 22. One <br />of tb: bids was submitted at several minutes past 4:00 p.m. The <br />first bidder has disputed the acceptability of the bid received <br />after the 4:00 p.ri. submission time. The City Attorney has <br />indicated there is no legal requirement for us to reject the second <br />bid. <br />It is staff's recommendation that the second bid be accepted. If <br />Che Council determines the second bid should be accepted there are <br />a number of options as to how to proceed with determining which <br />offer to accept. These range from simply accepting the highest bid <br />to allowing additional negotiation by both parties in terms of <br />their offers. <br />,1
