Box 66 <br />Crystal Bay, Minnesota 55323 <br />This is in regard to your telephone conversation with Mr. James Nye concerning <br />granting a single project variance for the city of Orono municipal project at <br />Stubbs Bay. <br />The Minnesota Department of Health (MDH) will consider a single project <br />variance if controls and responsibilities can be worked out to administer the <br />variance. The MDH would suggest the following procedures to facilitate the <br />project: <br />1.Recommend that the city incorporate an agreement in the variance <br />request that authorizes the city to act on behalf of the property <br />owner for the purposes of the variance. The agreement does not need <br />to be elaborate, and should be as simple as possible. <br />2.The variance approval, if granted, should clearly identify the city of <br />Orono as the entity responsible for insuring compliance with the <br />conditions of the variance. <br />3.All relevant historical information related to this project should be <br />incl-uded in the variance approval. This will document the conditions <br />under which the variance was approved. <br />A <br />4.In addition, the MDH legal staff suggests that we consider making the <br />variance recordable with the property deed. Both the MDH and the city <br />of Orono need to consider what might happen if a property sells <br />between the time of the variance request and approval. <br />We would be pleased to work with you on this matter.
