Planning & Zoning Administrator <br />% <br />% <br />July 20. 1993 <br />SUBJECT: Stubbs Bay Sewer Connections - Group Setback Variances <br />List of Exhibits <br />A - Minnesota Department of Health (MDH) Letter 7/2/93 <br />B - Staff Memo 7/16/92 <br />In 1992 staff identified as many as twenty-four potential connections within the Stubbs <br />Bay project which, due to existing site improvements and narrow lot widtns, would potentially <br />not be able to meet the State 20’ well setback requirement. Our initial contact with MDH <br />sucgested they would allow the City to apply for setback variances on behalf of the Stubbs Bay <br />residents as a group, thereby reducing paperwork and eliminating the variance fee. <br />In most of these two dozen cases, the need for a variance is caused by one of the <br />following: <br />A. Existing building sewer exits house less than 20’ from existing well. <br />B. Location of well in front yard of narrow 50 ’ lot (and location of neighboring <br />wells) makes it impossible to meet 20’ setback when piping from back yard septic <br />location to sew'er connection in the street. <br />In some cases, setback variances can be avoided by rerouting plumbing inside the house <br />when feasible. <br />For those connections which cannot meet the State requirements, staff would recommend <br />that the City apply for a single "project variance" on behalf of the affected property owners, <br />saving them the $50.00 application fee (Ihe City is exempt from this fee). This would involve <br />the following steps: <br />1. Staff identifies which properties need variances. <br />Staff provides a site plan for each property documenting existing conditions and <br />whv the connection cannot meet codes (these site plans were completed last year). <br />3.Staff to draft a short form to be signed by each property owner authorizing City <br />to act on his/her behalf. <br />} <br />/
