Building & Zoning Administrator <br />July 6. 1993 <br />COUNCIL MEETluU <br />,1UL 1 2 '995 <br />CITY OF ORONO <br />SUBJECT: ;!^1834 Mar>' McCany, 245 Tonka Avenue/Variance - Resolution <br />Zoning District - LR-IA, Lakeshore Residential <br />Brief Review of Application <br />Applicant has applied for lot area and lot width variances for Lots 5 and 6, Block 3 <br />located in the Stubbs Bay sewer district approved for sanitary sewer service (review Exhibit G. <br />Resolution #3167). Council members may remember that Lots 3 and 4 to the immediate north <br />were not approved for sewer as the current owner plans to let the properties go tax forfeit <br />(review Exhibit F. Resolution #3166). The applicant must proceed with the variance application <br />as proposed as a condition of the sale of the property. It is the full intent of Ms. McCany to <br />acquire the properties at the time of the release at the public sale. Lots 3 and 4 shall be released <br />for sale to only adjacent property owners for combination purposes. The owner to the <br />immediate north has advised that they are not interested in acquiring the property. It is not clear <br />as to the intent of the property owner to the immediate west. The County advises Ms. McCarty <br />that she will not be advised of the release of the properties for sale unless she is listed as the <br />owner of parcels 5 and 6. <br />Applicant is aware that the limited building envelope will necessitate the need for a <br />setback variance at a later date with the development of the site. Review Exhibit D, applicant <br />is not able to provide a comprehensive development plan for the site until the area and width <br />of the property is finally resolved. It is staffs understanding that the properties will be released <br />for sale to adjacent land owners some time in September. <br />It was difficult for Planning Commission members to approve the variance application <br />knowing full well that applicant will be filing a future variance application for setback variances. <br />The Planning Commission chose to act on the variance application in consideration of the fact <br />that the applicant is obliged to follow through with the variance to complete the conditions of <br />sale and that pending resolve of tax forfeit lands, applicant cannot provide a development plan. <br />The Planning Commission recommended unanimous approval of the lot area and lot width <br />variances based on the findings and hardships set forth in applicant s hardship statement and staff <br />memo. The enclosed resolution has been drafted per the findings and conditions set forth in the <br />Plannine Commission recommendation.
