PAUL, 032 <br />pleso <br />^MV 1903 i <br />< w : <br />The Honorable Edward Callahan <br />Mayor, City of Orono <br />2545 North Shore Dr., Box 72 <br />Crystal Bay, MN 55323 <br />Dear Mayor Callahan: <br />received <br />region VI <br />WATERS <br />APPROVAL OF ORONO'S FLEXIBILITY REQUEST AND CONDITIONAL APPROVAL OF ' <br />SHORELAND MANAGEMENT CONTROLS <br />Thank you for submitting your community's request for flexibility <br />from the statewide shoreland rules and your city's shoreland <br />management controls which were previously adopted on February <br />24,1992 for the Department of Natural Resources (DNR) review, I <br />will address the flexibility request first and then discuss DNR's <br />conditional approval of the shoreland controls. <br />Your predecessor’s letter of March 12, 1992 included city staff <br />memoranda which requested flexibility from statewide standards in <br />the following areas: <br />1. reduction of the structure setbacks from right-of-way <br />lines (primarily from, streets and roads) , <br />2. increase the structure height limit, <br />3. elimination of the setback requirement for lock boxes of <br />limited size, and <br />4. relaxation of the impervious coverage requirement based <br />on increased distances from the ordinary high water level <br />of the protected water body. <br />The city's letters and attached materials adequately describe <br />those situations and justifies its request. I am hereby fully <br />approving the city's request for flexibility. <br />I also am informing you that the city's land use controls are <br />conditionally approved at this time. Your controls will fully <br />comply with Minnesota Rules, Parts 6120.2500 - 6120.3900 provided <br />that the conditions identified during our review of your city's <br />ordinances and outlined in the attached pages are addressed and <br />incorporated into your land use controls during the next ordinance <br />amendment process. <br />We remain available to assist the city with the needed amendments <br />along with the implementation and enforcement of the shoreland <br />controls.
