' . .• <br />0^yu. ^ <br />(b) System Construction Status Definitions: <br />i. "New System" - Any proposed system or <br />any newly constructed system, which construction takes place after <br />the adoption of this Section, shall be a "new system" until the <br />time of 'final inspection and approval by the City. <br />ii. "Existing System" - Any system con <br />structed and in use prior to the adoption of this Section. "New <br />systems" shall become "existing systems" at the time of final <br />inspection and approval by the City. _____________ <br />(c) System Conformity Definitions: <br />i. "Code System" - A system which meets <br />all the location, design and construction standards of the current <br />City Codes, and which is operating satisfactorily by treating and <br />disposing of the entire current sewage input without discharging <br />any pollutants into ground or surface waters. _ ^ <br />ii. "Conforming System" - A system which <br />does not meet all the location, design and construction standards <br />of the current City Codes, but was installed according to the code <br />in effect at the time of installation, and_ which is <br />satisfactorily by treating and disposing of th.g ^^entire current <br />sewage input without dts-Ghairp±TTg-aTry.^po 1 lutants iTrto^ground or <br />surface waters. ^^ iii. "Non-Conforming System" - AAprohi- <br />bited system; a\system located within a designated^lOO-year <br />floodplain; any sy^trem-which may or may not meet__aJ-I-^the location, <br />design or construction standards of the current City Codes <br />which is failing for any reason; and any system with less than 3 <br />feet of unsaturated soil or sand between the distribution device <br />and the limiting soil characteristics. <br />iiii. "Failing System" - Any system which <br />is being used beyond its capacity or for any other reason has <br />failed to treat properly and/or dispose of the entire current input <br />and is therefore: ^ , <br />(1) Discharging pollutants, or any <br />liquid, to the surface of the ground or the ground water or to any <br />lake, stream or other body of water; or, <br />(2) Not accepting sewage input from an <br />occupied building; or, <br />(3) Creating a safety hazard due to <br />unprotected or improper construction or maintenance; or, <br />(4) Creating a public nuisance in any <br />manner . <br />11. "Owner" - Any person having legal or equitable <br />title or sufficient proprietary interest in any building or <br />subject to the provisions of this Section. For purpose ^ <br />notification, the owner shall be the occupant of the property or <br />the person listed as taxpayer on the current tax rolls. <br />ORONO CC 491 (2-10--92)
