Marina Licensing <br />June 11, 1993 <br />Page 2 <br />B. Current Problems and Magnitude. In determining the current purpose and extent of <br />marina regulation, the City needs to determine what the current problems are and <br />what the magnitude of these problems is. For example, outside of the few ongoing <br />complaints from specific residents, does the general public perceive that the marinas <br />are "out of control"? What very specific factors lead to this perception if it exists? <br />What specific changes do residents want the City to pursue? Staff s perception of the <br />problems is as follows: <br />1. Traffic control. <br />2. Aesthetics. <br />3. Passive environmental control (factors related to the physical makeup of the site) <br />4. Active environmental control (factors related to use of the site, such as boat <br />density, noise, and site operation). <br />These problems do not require detailed regulation of the marinas but they do require <br />some level of overall control of the marina operations. This level of control can oe <br />achieved with the "envelope" approach along with some additional general regulations <br />in the areas of parking and environmental issues such as surface water management. <br />Proposed Licensing Ordinance <br />Attached is the draft Licensing Ordinance that was presented to Council in December. <br />This ordinance reflects the recommendations of the Lake Use Committee last fall. <br />The proposed ordinance separates the Joint Use Licenses from the Marina ^iness <br />Licenses. The Joint Use Section more clearly defmes what is and isn't consider^ a joint use. <br />and sets tninitniim standards for joint uses regarding number/density of boats, joint uses in the <br />RS (island) Zoning District, and parking. <br />The Marina Business License becomes a new section, 5.43. This section includes <br />definitions of business uses, and includes a short list of business use standards including: <br />1. Adherence to the B-2 Zoning District requirement. <br />2. An insurance requirement, <br />3. License holder notifies City of all other businesses happening on the property <br />4.
