Mabusih, Building & Zoning Administrator <br />June 25. 1993 <br />^ % <br />1*1^1831 Edward Engler, 3450 Birch Lane - Variances - Public Hearing <br />Additional Exhibit <br />M - Applicant’s Letter of May 24, 1993 Requesting to be Scheduled Before the <br />Council Meeting of June 28, 1993 <br />The applicant proposes a 12 ’ x 20 ’ addition at lakeside of the existing residence located <br />out of the 0-75 ’ setback area and will be placed over an existing concrete patio. To the <br />northeast side of the residence, applicant proposes a 16’ x 24 ’ addition meeting the required 10’ <br />setback, ’lakeside addition and portions of the side addition will encroach the average lakeshore <br />setback line. Applicant proposes the removal of existing non-structural improvements to offset <br />structuial expansions. Structural coverage will be at 15.06%. Hardcover has been reduced and <br />is proposed within the 0-75 ’ setback area at 2.93% and in the 75-250 ’ setback area at 43.43%. <br />The Planning Commission unanimously approved the Engler application finding the <br />average lakeshore setback encroachment negligible as existing residence to west side is already <br />impacted by existing structure and residence to the east .side of property is buffered by a 7-8’ <br />high arborvitae hedge providing year round buffer. Members questioned the possible reduction <br />ofthe proposed addition so that lot coverage would not be exceeded by .06%. Applicant advises <br />that the proposed improvements were trimmed back considerably from the original proposal and <br />horizontal e.xpansion was tlie only available option as the foundation of the existing house could <br />not sustain a second story. Hardcover was the major concern for the Planning Commission as <br />43 -h% hardcover was deemed excessive on the 21,630 s.f. property. Staff advised members <br />that 1,960 s.f. or 13.9% of the hardcover within the 75-250 ’ setback area was asphalt driveway <br />that serves as turnaround and snow storage area tor the City. Birch Lane right-ot-way stops at <br />the west lot line of the property. Vehicles that travel on Birch Lane use applicant’s property as <br />a turnaround. Public Works Director has con.irmed that the property is used for storage and <br />applicant repims that the City has replaced piantings that were damaged by snow maintenance <br />vehicles. <br />A member of the Planning Commission asked if an easement could be granted over the <br />property assurinc the City that this area will be available and remain tor City s use. Any other <br />applicant would have been asked to reduce the size ot the paved area to offset hardcover <br />increases, the e.xcessive hardcover on the site results trom the extensive paving in the street yard <br />If the paved area was reduced, it would create major snow storage problems tor City and
