JACK REMEIN (3237 CASCO CIRCLE) , LOT <br />WIDTH VARIANCE FOR LOT HELD IN COMMON OWNERSHIP, LAKE <br />MINNETONKA (27-133, #9), CITY OF ORONO, HENNEPIN COUNTY <br />Dear Ms, Mabusth: <br />We have raviewod the above-referenced variance application whicn <br />involves contiguous nonconforming lots of record that are under the <br />same ownership. <br />The DNR's model shoreland management ordinance (based on the <br />3, 1989 statewide standards) specifies that lots of record on the <br />date of enactment of the local shoreland controls that do not meet <br />the minimum area and width requirements may be allowed as building <br />sites without variance provided: “the use is permitted in th <br />zoning district, the lot has been in separate ownership from <br />abutting lands at all times since it became substandard, was <br />created compliant with official controls in effect at the time, and <br />sewage treatment a,id setback requirements of this ordinance are <br />met." (Section 6.1, A.) <br />Section 6.1, C. in the DNR model further specifies that if, in a <br />oroup of two or more contiguous lots under the same ownership, any <br />individual lot does not meet the area and width standards of the <br />ordinance that the lot must not be considered as a separate parcel <br />of land for purposes of sale or development, but must be combined <br />^j[th the one or more contiguous lots so the meet the area and width <br />requirements as much as possible. <br />In Orono's Section 10.03, Subd. 6, A., 1., it states that a lot of <br />record which is <br />... serviced by public sanitary sewer and which does not <br />meet the requirements of this Zoning Chapter as to area <br />or width only, may be utilized for single family detached <br />dwelling purposes without council approval if the area <br />measurements and width of, that lot area within eighty <br />percent (80%) of the requirements of this Zoning <br />Chapter. However, the lot of record shall net be more <br />intensely developed unless combined with one or more <br />abutting lots or portions thereof so as to create a lot <br />meeting the requirem.ents of this Zoning Chapter. <br />AN tOU/»u OPPORTUNITY EMPLOYER
