Zoning File #1201 <br />December 14, 1987 <br />Page 2 of 3 <br />In regard to Planning Commission's concern with the size and <br />configuration of Lot 7, staff would suggest that final plat resolution <br />include a disclaimer advising future owner that if property is divided in <br />the future, such division will be subject to all pertinent municipal <br />ordinances effective at that time. Thert* would be no legal basis to state <br />lot cannot be subdivided in the future. <br />As for concern with underground drainage tiles, review Exhibit F, the <br />only area draining to the east is a small watershed designated with slash <br />lines. If drainage is affected by land alterat.ons on the subject <br />property, drainage would be picked up at road ditches on Old Crystal Bay <br />Road, but once again, the area is minimal in area and v/e have no record of <br />such underground lines existing. Please advise staff if you have any other <br />concerns with this division as proposed prior to the meeting so that staff <br />will have adequate time to gather or define new information for your <br />meeting. <br />Staff Recommendation - <br />To approve the proposed 11 lot plat subdivision of Mike Hilbelink and <br />John Vogt finding all pertinent sections of the subdivision, zoning and on <br />site septic codes have been satisfied and tr t a variance to all 11 <br />lots to be served by private roads finding the pa.acement and design of such <br />roads would provide adequate and safe access for the public who use the <br />roads. <br />Such approval is subject to the following conditions: <br />1.Underlying road and utility easements to be granted over all road <br />outlots. <br />2.Conservation & Flowagc^ easement taken over designated wetland. <br />3.Lots 1, 2, and 3, Block 1 are classified as through lots. Future <br />owners are placed on notice that a conditional use permit is required <br />prior to the installation of accessory structures. <br />4. Septic testing or a letter from the on-site septic evaluator. Bob <br />Koch, confirming adequate area for an alternate septic site on Lot 2, <br />Block 1. <br />5.Relocate existing drainageway on Lot 2, Block 2 to east lot line <br />within 10' wide drainage easement. <br />6.Per Section 11.33, Subdivision 4, plat roads to be constructed as <br />follows; <br />A.East/west road 28' minimum paved width. <br />B.North/south road 24' minimum paved width. <br />7.Park fee of $2,000 ($200.00 x 10 lots).
