City of OEiOIVO <br />RESOLUTION OF THE CITY COUNCIL <br />NO, 2252_________ <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 15 (F) <br />FILE #1056 <br />WHEREAS, Olai Hanson (hereinafter "the ^Orono <br />of the property located at 1390 Railroad Avenue within the City of Orono <br />(hereinafter "City") and legally described as follows: <br />Exhibit A attached (Hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the nprnfit^\he <br />Municipal zoning Code Section 10.03, Subdivision 15 (F) ,ine <br />construction of a detached garage located 4.6 feet from the side <br />where a side yard setback of ).0 feet is normally required. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1.This application was reviewed as Zoning File #1056. <br />2. The property is located in the LR-IA Single Family Lakeshore <br />Residential Zoning District. <br />3.The Orono Planning Commission reviewed this ^PP^ <br />21, 1986, September 8, 1986 and August 17, 1987 and <br />approval of the proposed variance on a vote of 4 ^ <br />upon the finding that construction of the garage <br />lot line will not to a significant degree infringe upon the amount o^ <br />sunlight falling upon the neighboring property owned by Mrs. Goiae . <br />4.The side setback encroachment of 5.4' is necessary to reduce <br />the angle of vehicle entry into the garage due to the close proxi y <br />of the existing house. <br />5.Disturbed soils in the former septic system locatio^n are not <br />suitable for construction of a garage and are <br />garage could not be located to meet the required 10 side setback <br />unless soil correction measures are undertaken. <br />6.The City Council has considered this application <br />findings and recommendations of the Planning <br />City staff, comments by the applicant and the effect o -P P <br />variance on the health, safety and v/elfare of the community. <br />Page 1 of 4
