Mabusth, Zoning Administrator <br />DATE: <br />SOBJ: <br />December 9, 1987 <br />#1216 Clark Winslow, 1595 Bohns Point Road - <br />Amendment of original Conditional Use Permit/Variance <br />List of Exhibits - <br />A - Original Plan <br />B - Amended Plan <br />C - Cross Section of shoulder of road <br />At the request of the City of Orono, the applicant has agreed to reopen <br />consideration of application #1216 that involved the dredging and removal <br />of 1548 cubic yards of spoils from a designated wetlands. <br />In the process of making borings in the area to be dredged, the contractor <br />discovered extensive pockets of yellow clay. The soil's stability - <br />cohesive, plastic qualities are excellent for City to use in restoring and <br />widening shoulder areas of Bohns Point Road. Please note these soils are <br />not customary spoils ladened with rich nutrients. There is no danger of <br />contaminating water quality of runoff to and from wetlands. Portions of <br />the road right-of-way are located within the wetlands. The area of the <br />road restoration runs a distance of 130 feet adjacent to wetlands for a <br />depth of 12 feet. The 650 cubic yards of clay will be deposited or filled <br />within the east edge of the wetland. <br />Winslow has agreed to excavate the west edge of the existing wetland to <br />compensate for filling on the east side of wetlands. <br />Staff recommends approval of the land alteration that would allow the <br />filling of the designated wetlands located within the road right of way of <br />Bohns Point Road based on these additional findings: <br />1. The land alteration will greatly improve the existing road by <br />widening the road bed and providing gentler slopes adjacent to <br />wetlands. <br />2. Owner of adjacent property will provide additional ponding area on <br />his property to compensate for fill of vv? ands. <br />Resolution #2296, approved by Council on 11/9/87, has been amended to <br />include this final land alteration. This amended application will be <br />presented to the Planning Commission at their 12/21/87 meeting as an <br />information item. The scheduled dredging by the applicant and the normal <br />schedule of the Planning Commission meetings made it impossible to schedule <br />at the Planning Commission before Council action.
