When should the work be completed? If the Planning Commission <br />and Council feel thac applicant should share in the costs of a <br />private culvert upgrade project, then the other two directly <br />benefitted ov/ners must also agree to spend money at this time.... <br />It would seem there needs to be some agreement on all sides in <br />order for this upgrade to happen privately. If the neighboring <br />property owners insist that the project become a public j ject, <br />shared by all benefitting property owners, whether their ..onefit <br />is direct or indirect, then the attendent costs of such a project <br />will undoubtably rise. <br />Staff recommendation <br />Staff would recommend approval of the lot area variance renewal <br />finding that; <br />A. There is no additional land available for purchase to <br />make this a conforming parcel. <br />D. The lot area is consistent with that of other <br />developed lots in the neighborhood. <br />C. The variance was previously granted in 1980. <br />D. Sewer is available and has been assessed for a total <br />of one unit. <br />E. Ample area exists on the lot to develope a single <br />family residence and a pertinent improvements without <br />the need for further variances. <br />Approval is subject to; <br />1. Setbacks of 35 fi-et from the west, south and east lot <br />lines and 10 feet from the north lot line. <br />2. Payment of park fee of $390.00 at the time a building <br />permit is issued. <br />3. Legal combination of all four lots into one tax <br />parcel must be filed and accepted by Hennepin County <br />prior to issuance of a building permit. <br />4. Hardcover allowed (2/3 in 250-500', 1/3 in 500-1000’) <br />may not exceed 8,360 square feet on the property. <br />5. Applicant shall grant a drainage easement over the <br />westerly and southerly 10 feet of the property. <br />6. Improvements to the property may not ~cJ»ong-e <br />drainage pattern in the neighborhood. Applicants shall <br />share in the costs and shall share in the responsibility <br />for improvements to the drainageway and culvert <br />underneath the driveway serving the two properties to
