Mabusthr Building 6 Zoning Administrator <br />October 14, 1987 <br />Subject: #643 Mrs. Camille Curtiss, 1920 Fagerness Point Road - <br />Reconsideration of Variance Application Approved 9/14/81 - <br />Second Review <br />Recap of September 21, 1987 Meeting - <br />The Planning Commission advised the applicant that they would <br />recommend that turnaround be provided because of the safety factor and that <br />staff should work with applicant because of need to place turnaround in <br />portions of unused right-of-way of Fagerness Point Road. Planning <br />Commission would act on question of fence as soon as the applicant's <br />property lines are defined and staked. <br />Current Review - <br />The applicant has failed to authorize their surveyor to stake property <br />line adjacent to the street. Staff contacted the surveyor's office and was <br />advised that field crews were ordered off site and not to proceed with <br />their assignment. <br />It is staff's opinion that the fence is located within the right-of- <br />way based on original survey and information submitted by applicant during <br />the first review in 1981. If applicant is to install a conforming fence in <br />the future, the fence must be located within the boundaries of the subject <br />propel . <br />Staff Reconsnendation - <br />To recommend to the Council that a turnaround be provided for safety <br />considerations per directive of the Orono Council o. September 14, 1981 and <br />to recommend that the non-conforming 6 feet privacy fence be removed from <br />either the right-of-way or the applicant's street yard, and that, if <br />applicant wishes to install a conforming 2H feet fence, such fence must be <br />installed within the certified boundary lines of the subject property and <br />out of the lakeshore otected area (0-75').
