•;>. .V. <br />(9lniirK'lo;j <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2194_ _ _ _ _^ <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Ba^sed upon one or more of the above findings, the Orono City <br />Council hereby grants the variances as set forth above and approves the <br />commercial site plan dated April 20, 1987 by R.L. Wuornos and Associates <br />for Smith’s Bay Marina & Yacht Club, Inc., subject to the following <br />conditions: <br />1. Owner to execute a Developer's Agreement and post a letter of <br />credit with the City to insure the following improvements are <br />installed by,August 31, 1988. <br />a) Drainage/surface water treatment improvements per final plans <br />approved by the M.C.W.D. and City of Orono - the City would ask <br />that an underground drainage tile system be located and its use <br />reviev;ed as part of that improvement. <br />b) Paving of parking area, lighting, signage, and installation <br />of grassed area per plans by R.L. Wuornos and Associates dated <br />4/20/87. <br />c) Reconstruction of dock adjacent to shoreline in conjunction <br />with shoreline restoration - areas of dock located above the <br />929.4 elevation not to exceed a 6 feet width. <br />d) To construct a six feet high privacy fence along the west <br />side lot line adjacent to the public access. <br />2. The executed Developer's Agreement and letter of credit (amount to <br />be 150% of the cost of requirement improvements) must be submitted to <br />the City prior to application for a building permit for new principal <br />structure. City Engineer shall review total estimate of improvement <br />costs prior to submittal of letter of credit. <br />3. Erosion control shall be employed at all times on the site during <br />the time of the construction of the principal structure and the <br />shoreline restoration. <br />4. Owner/applicant shall apply ? <r a building permit with penalty fee <br />for commercial dock construct*-.*d prior to his ownership of the <br />property. <br />5. Demolition permits are required for all buildings to be removed. <br />Such permits must be obtained by applicant at the time a permit is <br />issued for new construction. A certificate of occupancy will not be <br />issued for the new structure until all buildings designated for <br />removal have been razed. <br />6. owner/applicant is hereby advised that at the time an application <br />for building permit is submitted to the City, the Orono staff shall <br />evaluate the proposed improvement and uses of the property per <br />standards adopted by Metropolitan Waste Control Commission in the <br />determination of Service Availability Charges to be collected with the <br />issuance of a building permit. <br />Paqo 3 of 5 <br />.1
