If an access corridor is extended through Lot 2 to <br />serve Lot 1, this roadway may have to be redefined if Lot 2's dry <br />continuous area is reduced. <br />Lot 3 - The former access corridor (consisting totally <br />of wetlands) to the Miner homestead that was never developed will <br />be combined within Lot 3. Please note on your plat map that this <br />too is d seperate legal parcel. The proposed access drive to the <br />Miner homestead will also divide the severly limited building <br />site of 2.4 acres. The drive as proposed creates a substandard <br />dry contiguous building envelope for Lot 3 and cannot be allowed <br />per Section 10.03 Subd. 6(B). Access to the Miner homestead <br />shall remain as proposed to the Council via the east access <br />easement. The existing structures on the property should be <br />designated by the surveyor. <br />Wetlands. <br />The City shall ask for a Flowage and Conservation <br />Easement over the 9.4 acres of wetlands. These wetlands should <br />be designated on the preliminary survey with angles and bearings. <br />Riparian Issue. <br />The applicant should submit addendum information <br />regarding their desires concerning the use of this tract. The <br />inclusion of Lot 3 will necessitate consideration of private road <br />designation and road construction by the developer. The <br />applicant may ask for the City's consideration regarding <br />extension of riparian rights to either Lots 1 or 2, or both. If <br />this is the intention of the applicant, the City should be <br />advised. The applicant should include in that request the <br />surveyor's estimate of shoreline lineal footage. Note the lagoon <br />configuration will benefit the applicant. <br />No matter what the resolve of the final use of the <br />riparian tract, the riparian property must be disignated as an <br />Outlot on the plat. The Outlot shall be legally tied to an <br />inland lot with a special lot combination that would confirm the <br />Outlot of 1 acre as unbuildable and for the exclusive riparian <br />use of the owner of the inland lot. The combination also insures <br />both riparian Outlot and inland lot would be sold as one unit in <br />the future. <br />Access and Hoad Right of Way <br />There will be obvious road dedication for the County <br />Hoad. The proposed three lot plat will require creation of a <br />private road to serve at a minimum the three proposed lots and <br />Miner homestead in addition to the adjacent Anderson and Gardiner <br />properties, review the enclosed staff sketches and plat map. The <br />staff proposal would suggest use of the existing 33 feet wide <br />alley of the ottoville plat on the east side of Lot 3. <br />Additional 17 feet can be acquired from Lot 3 with a turnaround <br />provided that would serve all adjacent properties.
