Both Mr. Dennis and Waters agreed <br />that even with the storm of July 23rdm the swale worked and even <br />the existing elevations with no vegetation sustained little <br />damage. <br />Options for action by the Planning Commission - <br />A. Deny the after-the-fact conditional use permit: <br />1. Require total replacement - tell applicant to redesign <br />house from current walkout. <br />2. Require partial replacement - allow for minimal <br />excavation for walkout to function. <br />Issues to answert <br />a) How does applicant deal with drainage from east? <br />b) If previous contours restored, applicant will still <br />have severe erosion problems along 1.1 grade slopes of <br />lakeshore banks especially at those slope grades with <br />the use of disturbed soils. Will Planning Commision <br />allow stone retaining wall at this point? <br />B. Approve applicant's original plan based on findings listed in <br />Kopischke's review with no further structural encroachment of <br />lakeshore protected yard as follows; <br />1. Stairs from deck relocated to south out of protected <br />area. <br />2. Additional access improvements required because of severe <br />slopes within lakeshore protected area must be via grade <br />level steps built into existing banks, <br />C. Approve plans as amended by staff with conditions 1 & 2 as <br />noted above in item B.
