NCWHALL <br />RETIRED <br />THOMAS VENNUM <br />March 12, 1987 <br />Members of the Orono City Council <br />and Orono City Planning <br />Commission (see list attached) <br />Re: 1390 Railroad Avenue <br />Variance for Garage Construction <br />Ladies and Gentlemen: <br />This office represents Olai Hanson, owner of the above-described <br />property. It is my understanding that Mr. Hanson applied for a <br />variance to build a garage upon his property, which variance was <br />required due to the proposed nonconforming setback of the garage <br />to the property line. <br />I have had the opportunity to meet with Michael Gaffron, Assistant <br />Zoning Administrator, with regard to this matter. Mr. Gaffron <br />tells me that the Orono City Council tabled the matter until Mr. <br />Hanson and his neighbor, the Goldens, resolve their dispute with <br />regard to the location of the property line. It is my under <br />standing that the Goldens believe that the property line falls 2.9 <br />feet to the southwest of the area where my client believes the <br />property line falls. <br />While I am willing to initiate litigation with the neighboring <br />property owner regarding the actual location of the property line, <br />I have advised ny client that even if Mr. Hanson was to prevail in <br />the litigation, the City Council would need to rule on the <br />variance requested by Mr. Hanson inasmuch as the garage would <br />still be located six feet nine inches (6'9") from the nearest <br />property line. At its greatest distance, the garage would be nine <br />feet four inches (9'4") from the property line. <br />Accordingly, this letter is to request the City's assistance in <br />rehearing this matter. Inasmuch as a lawsuit will not resolve the <br />need for a variance, Mr. Hanson is requesting that the City <br />reevaluate its position taken at the last City Council meeting <br />held in this regard on Septemoer 8, 1986. <br />I would appreciate the opportunity to fully explain this position <br />to the Planning Commission and/or the rouncll.
