Zoning File #1181 <br />August 13, 1987 <br />Page 2 <br />In March of 1981, the City approved the two lot plat, Orono <br />Hills, for the current owner providing for the division of the <br />properties along the zoning boundary lines. The application <br />involved the dedication of flowage and conservation easements <br />over the wetlands (defined at the 940 elevation) and a landscape <br />easement over 10 feet of Lot 2 along the shared lot line of Lots <br />1 & 2 providing a landscape buffer to the adjacent commercial <br />property. In that approval, the City excluded from the <br />restrictions of that flowage and conservation easement a 60 feet <br />wide corridor for driveway purposes at the southeast edge of <br />property at Kelly Ave. <br />The City has reviewed several sketch plans for development of Lot <br />2 under a PRD seeking anywhere from 9 to 10 units. Formal <br />subdivision plans were never filed. <br />Review of Current Application — The current proposal involves a <br />formal plat creating 4 lots for single family residential <br />development. The property is served with municipal sewer and <br />water and qualifies under Section 10.55 for wetland credit <br />against required lot areas. The applicant is advised that the <br />wetland area is defined at the drainage easement line and its use <br />governed by the restrictions of the flowage and conservation <br />easement. The dry buildable envelope of each lot meets the <br />required minimum 1/2 acre of dry contiguous land per Section <br />10.55 A(2) and per 10.55 A(3) the wet areas do not exceed the dry <br />lands within each envelope. <br />Each lot meets the required 140 feet of width. Building sites <br />will be located within the higher, gentler, sloped areas to the <br />north. The engineer has asked that once the division lines are <br />determined that building sites be designated on each lot so that <br />the City can make recommendations as to the extension of <br />municipal sewer and water lines. The lines would be extended <br />within the shared drives right-of-way. The City will ask for the <br />granting of access and utility easements over the municipal <br />lines. <br />The preliminary plans must designate the approved building <br />envelopes (26 feet from 940 elevation wetland, 30 feet rear and <br />10 feet side). <br />Staff approves of the two shared driveway accesses rather than <br />private road serving all four lots. The engineer's review <br />summarized the staff position. <br />"difficult topography, private road construction could <br />potentially result in greater damage to the existing wetland <br />area adjacent to Kelly Ave," <br />The southern access is excellent but the northern drive must be <br />moved further north approximately 100 feet with adequate distance <br />from the curve. The proposed access location is located across <br />from 4 curb cuts all located within approximately 50 feet area. <br />Sight distance is not adequate for 30 mph road. The recommended <br />curb cut would be placed opposite the shared drive that servos
