^t)T O'}, <br />itw <br />\\ <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO.3194 <br />c) Approximately 744 s.f. of the hardcover within the 0- <br />75* setback area has been installed because the <br />historic erosion problems of the steep lakeshore bank <br />which was intensified at the time of the 1987 storms. <br />d) AoDlicant has provided written affidavits ^tom <br />contractors and friends confirming that deck and g^^ebo <br />structure was constructed prior to the 1987 storm and <br />constructed sometime in the early '80s. <br />4. The City Council finds that the conditions <br />oroperty are peculiar to it and do not apply ge <br />?ther property in this zoning district; that <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring property; would not merely serve ^ <br />SInvenience to^^the^applicant, but is necessary to aHev t <br />a demonstrable hardship or difficulty; is f <br />preserve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />q The Citv Council has considered this application including <br />the findings and recommendations of the Planning Commissi^^ <br />reports by City staff, comments by the applicant and the <br />effect of the proposed variance on the health, safety a <br />welfare of tha community. <br />CONCLUSIONS, 01 )ER AND CONDITIONS <br />».“r4 <br />decking ®conl«ilted" w\thoj.t^ <br />1.
