Box 66 Crystal Bay, Minnesota 55323 Subject:Drainage Ponds on the Richard Dunlap and Robert Winchell Property Dear Jim: As you are aware, we looked at che drainage ponds on the Richard Dunlap and Robert Winchell properties with the resulting drainage across the Reginald Farrell property. The ponds have been constructed without permits and the pond on Mr. Dunlap's property overflows and drains into Mr. Winchell*s pond. Apparently in the construction of the ponds, Mr. Dunlap ran into a spring v;hich provides a continuous flow of water the ponds. A drainage ditch v/as constructed from Mj?» Winchell's property to a creek on Mr. Farrell's property. We understand that this was constructed without permission from the property owner and this has been a soui'ce of contention. We also understand that this is a matter of litigation. Therefore, we are not responding at this time to the matter of vhe ponds themselves. V/e do, however, offer for your information the following possible solutions to this problem. 1.Mr. Winchell could obtain an easement from Mr. Farrell for the construction of a drainage ditch or pipe to carry the water to the creek. 2.The City could grant Mr. Winchell permission to con struct a drainage ditch or pipe along the City property to the ditch. This is approximately 100 feet. How ever, the City may want to require this water bo carried in a pipe rather than a ditch.
