F <br />TO:Orono City Counsel <br />DATE: June 3, 19B7 <br />FROH: Alan and Kin Slonin <br />RE:.4 #1154 - Land Application <br />In approxinately 1972 both OMners o^ 60 and 80 Cygnet place dug <br />essentially drain and dry their back yards; <br />ponds to <br />1. ) For a more eT-fective septic systems <br />2. ) For more useable yard space <br />3. ) To insure dryer basements <br />There is a natural spring in 60 Cygnet pond plus the rear area of both yards <br />are low points for drainage of abbuting Ferrell property, as well as all <br />surrounding high property. <br />To fill 80 Cygnet pond could result in an overflow of 60 Cygnet pond <br />(particularly in wet years) as both ponds are pre-connected the 80 Cygent <br />pond has a drainage system that flows into a natural creek bed. Filling <br />could result in flooding back yards of both 60 Cygnet Place and 80 Cygnet <br />Place and park area, because the current overflow drainage to the creek <br />would be altered. <br />We, 60 Cygent Place, have no objections to the owners of 80 Cygent Place in <br />filling in their pond. However, in the event that my pond, 60 Cygnet Place, <br />would overflow and flood 80 Cygnet Place which likely will happen in wet <br />years that we are not held liable. <br />In order for us not to oppose the filling, we would like in writing an <br />agreement from the owners at 80 Cygnet Place satisfaction to us stating that <br />we will not be held liable should there be any any overflow or flooding from <br />the drainage of our pond effecting their property.
