■ '..i <br />City of OROINO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 18^9_ _ _ _ _ _ <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) <br />FILE #947 <br />WHEREAS, Norman & Christie DeWitt <br />applicant”) has an interest in the property located at 1180 ^Y^an <br />Avenue within the City of Orono (hereinafter 'City ) and legally <br />described as follows: <br />That part of Tract A lying Easterly of the following <br />described line: Beginning at the most <br />said Tract A; thence Southerly to a point on the South line <br />of said Tract A, distant 120 feet West from the Northeast <br />corner of Tract B, and there terminating; all within <br />Registered Land Survey No. 1067, Files of the Registrar of <br />Titles, County of Hennepin, EXCEPT, that part of Tract A, <br />Registered Land Survey No. 1067, for road P^^poses, <br />deLribed as follows: That part of said ^^act A lying <br />within the circumference of a circle having a radius of 50 <br />feet, the center of said circle being the Northeast: corner <br />of Tract B, said registered land survey (hereinafter <br />"property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.28, <br />Jb) to permit the construction of a new residence a lot with <br />65,153 square feet in area instead of the required , <br />feet. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #947. <br />2. The property is located in the RR-IB Single Family Rural <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on August 19, 1985, and recommended approval of the proposed <br />variance based upon the following findings. <br />a) This parcel was created prior to the creation of <br />the RR-IB zoning district. <br />Page 1 of 4
