Zoning File #1147 <br />May 14, 1987 <br />Page 2 of 2 <br />Public Works Coordinator John Gerhardson has reviewed the proposal as <br />it relates to maintenance of the roadway. This is a critical area for snow <br />plowing because the right-of-way is only 16’ and the pavement is about 12- <br />13'. The neighbors 6' fence on the north side of the road (right at the <br />property line) causes severe drifting across the road; in the past, the <br />City has had to hire a private contractor with special equipment to move <br />the snow away. <br />(Serhardson suggests that if a 6' fence is allowed, it should be at <br />least 5' from the property line at the west end and could angle up to a <br />point about 12' from the house corner (see Exhibit F). He also suggests it <br />would be helpful if the applicants consider dedicating some additional <br />right-of-way to the City in this critical area. He warns that at the west <br />end of the property, any fence constructed at the lo'* line will have a <br />severe impact on plowing operations, will restrict the area that snow can <br />be pushed to, and would likely be damaged by plowing. We would certainly <br />like a hold-harmless agreement for any fence near the right-of-way. <br />Staff Recommendation - <br />Please consider this proposal in relation to: <br />1. The applicants' needs and hardships. <br />2. The City's needs for road maintenance purposes. <br />3. The fact that if applicants put a 3*i' legal fence at the property <br />line, it will have an even more severe effect on road maintenance than <br />a higher fence located some distance back. <br />4. The aesthetics of driving down Rest Point Road between privacy <br />fences. <br />If you find that a 6' fence should be allowed, staff recommends: <br />a) That it be no closer than 5' from the property corner at the west <br />end, and no further than 12' from the house at the jog in the house, <br />and then parallel to property line from that point east to the <br />driveway. <br />b) That a hold harmless agreement for the fence be granted to the <br />City even though the fence is on private property. <br />c) That the applicants be encouraged to consider dedication of <br />additional right-of-way along the road. <br />I <br />..odiAiiiitfm
