Eberhn <br />/ <br />Dear Jeanne, <br />We have reviewed the Leekley request relative to vacation of the drainage and <br />easement. We would recoiuiiiend that the easement not be vacated. <br />The easement could be modified to eliminate the ponding area if the property <br />owner desired. The easement should be modified as follows: <br />An easement for drainage and utility purposes over the following described <br />properly: <br />That part of Lot 3, Block 1, WILLOW RUN, lying within 10 feet on each side <br />of the following described centerline: Commencing at the Northeast corner <br />of said lot 3; thence Southerly along the East line of said lot 3 a dis <br />tance of 270 feet to the point of beginning of the centerline being des- <br />ctibcd; thence Northwesterly, deflecting right 117 degrees a distance of <br />162 feet; thence Southerly, deflecting left 116 aegrees a distance of 183 <br />feet; thence Southwesterly, deflecting right 14 degrees to the South line <br />of said Lot 3, and said centerline there ending. <br />The current casement could be eliminated if the property owner to the east on <br />Lot 2 would provide a new drainage way. The drainage way would run from the <br />pond to the Southwest corner of lot 2.
