Gaffron, <br />Assistant Planning & Zoning Administrator <br />DATE: <br />SUBJ: <br />March 11, 1987 <br />#1115 & #1116 Paul and Virginia Boyke, 795 North <br />Ferndale Road - Easement Vacation - Subdivision <br />Public Hearings <br />Zoning District *■ RR-IB, 2 Acre Unsewered <br />Application - <br />#1115 - Vacation of existing drainage and utilities easement <br />along existing interior lot line. <br />#1116 - Rearrangement of lot lines to make the existing vacant <br />lot feasible for owner's preferred house location. <br />Note: This rearrangement is a re-platting of the subdivision due <br />to the extent of changes proposed, and because of the necessity <br />to dedicate additional conservation 6 flowage easements and <br />future right-of-way. <br />List of Exhibits - <br />A - Applications #1115 and #1116 <br />B - Plat Map <br />C - Property Owners List <br />D - Survey <br />E - Survey with staff concerns and suggested layout of <br />replat <br />F - Airphoto portion <br />G - Long term conceptual sketch for future potential road <br />right-of-way <br />Note: Applicant has purchased both IiOts 1 and 2 of Brooks Green, <br />hence he controls the entire property in question. <br />I. #1115 - EASEMENT VACATION <br />A 10' wide drainage and utility easement was dedicated to the <br />public with the original plat of Brooks Green in 1980. That <br />standard easement was 5' either side of the lot division line, <br />and did not follow any established drainageway, but was merely <br />intended to provide a functjonal corridor for utilities while <br />serving no immediate dialnageway purpose, given the general <br />topography of the site. <br />Given that no utility or drainage purpose is currently served by <br />the existing easement, it is appropriate as part of this <br />replatting process to vacate the existing drainage and utility <br />easement along the interior division line, in exchange for the <br />granting of a similar easement along the re-platted lot lines.1
