The 37* wide corridor cannot be used for a new well location or <br />for septic expansion because of the 22*t variation in grade from the <br />higher elevations of the Halper property used for current residential <br />development. <br />2. Proposed division line corresponds with natural <br />physical/topographic boundaries. <br />3. The subdivision does not involve the creation of new building <br />sites, but merely involves the rearrangement of a shared boundary. <br />4. The rural property, defined as Parcel A on the survey, has a new <br />primary septic system and additional area for septic expansion in the <br />future. <br />5. All existing structures on Parcel A meet the required setbacks <br />from the proposed division line. <br />This approval would be subject to Mr. Born filing for legal <br />combination of Parcel B with Parcel C. <br />For members who cannot approve a division that involves the reduction <br />in area of a rural property that would require an area variance, staff <br />l#ould recommend that you refer to Section 11.02, Subdivision 10 for the <br />necessary findings for denial. <br />S. Vacation Application <br />If the proposed division is approved, the existing 10' wide drainage <br />end utility easement along the southern lot line of Lot 2, Block 1, <br />Dragonfly Hill (review Exhibit D) must be vacated and the City will ask in <br />return for the granting of a S' drainage and utility easement on either <br />Side of the new division line. The existing drainage and utility easements <br />would intersect the newly defined building envelope of combined Parcel B & <br />C.
