There is no basis on which the <br />City can grant approval for a structure that straddles a property <br />line. Note that although this structure is less than 120 s.f. in <br />area, hence it does not technically require a permit, it still <br />must meet the zoning setback requirements. <br />The applicants are proposing to mitigate the effects of the additional <br />run-off created by the pool and patio, by constructing the pool apron <br />such that all water falling on the pool and patio is contained within <br />the pool itself, with an overflow discharge at a presumably slower <br />rate into a drainfield to be located adjacent to the pool. Similar <br />types of run-off infiltration structures have been suggested by the <br />Hennepin Soil and Water Conservation District for use in lakeshore <br />areas, however, such a practice has not been adopted in Oreno. Note <br />that, if the drainfield system works as proposed, most of the debris <br />and nutrients carried in the run-off would be carried into the ground <br />for natural dispersal into the watertable.
