By
TOi Planning Commission Chairman Kelley
Orono Planning Commission Members
City Administrator Bernhardson
Froils Michael P. Gaffronr Asst Planning & Zoning Administrator
ITate:November 17, 1988
Subject s #1358 Tim Johnson/Ted Feig, 627-629 North Perndale Road
Renewal of Subdivision of a Lot Line Rearrangement -
Public Hearing
Application - Revise lot line between two properties to reflect actual
use pattern. This application was approved in 1987 but was never
filed. The current review is essentially a procedural matter» since
City code requires that if the subdivision approval expiresr the
approval process must be started over.
Zoning District - RR-IB
Zdnt of Exhibits
Exhibit A - Application
Exhibit B - Plat Map
Exhibit C - Property Owners List
Exhibit D - Survey
Exhibit E - Resolution §2222, Approved 7/27/87
Exhibit P - Council Minutes of 7/27/87
Discussl
Applicants originally proposed to revise the lot line between their
two properties. This was approved by the Council in 1987 and was not a
controversial application. Both properties remain at the two acre lot area
standard.
In conjunction with the lot line rearrangement, the applicants were
granted a vacation of the old drainage easements along the interior lot
line in exchange for new easements either side of the new lot line. The
easement vacation resolution was similarly approved July 21, 1987 and does
not have an expiration date, hence does not need to be renewed.
Note that the previous approval expiration was possibly a
®is-communlcation between applicants and staff. The documents that
applicants were supposed to execute and return to the City were never
returned. They claimed they never received them. Our application file
contains only copies of the packet sent to each applicant, not the
originals, hence we do not know for sure what happened.
Staff la iidatioa -
Staff recommends approval of the renewal of the metes and bounds lot
line rterrangement for Tim Johnson and Ted Feig at 627-629 North Ferndale
Road, finding that both properties will benefit from the proposed lot line
reasfangement•
4.’-TV <4^.-
I ■ :'* . .
