Vacation of 10' Wide Alley <br />In 1987, the City advised Bob Kost, in his lot area variance <br />application (#1195), to proceed with the vacation of the 1C* wide alley <br />running along the north line of the subject property (review Exhibit F) In <br />exchange for his grafting a quit-claim deed of additional right-of-way for <br />Tonka View Lane. The City has no intention of developing a 10' wide alley <br />within the unimproved right-of-way and finding no public use or interest <br />in the 10' dedicated right-of-way, the City would approve the vacation <br />subject to the developer dedicating drainage and utility easements adjacent <br />to all newly created lot lines. The City will also ask for additional <br />right-of-way dedication of all lots adjacent to Tonka View Lane. <br />B. Vacation of Garden Lane <br />The applicant's surveyor has advised that procedurally the most <br />expedient way to vacate the additional 10* of right-of-way within Garden <br />Lane would be to vacate the total roadway and replat with a 50* road. <br />Review Exhibit F, the City would consider the total vacation of Garden <br />Lane, if the Bulls and Rostads agreed to execute a 5' drainage and utility <br />easement along the newly platted road outlot. <br />C. Vacation of Portions of Highview Lane <br />The applicant seeks the total 60* vacation along the north lot line of <br />Lot 94 and the south lot lines of Lots 95 and 96. Once again, the new plat <br />road wilx be replatted at 50*. In exchange for the vacation of the 30* of <br />unimproved platted right-of-way along the north lot line of Lot 60, the <br />City will ask for a 10* drainage and utility easement to be platted along <br />the north line of proposed Lot 4 if there is a future need to improve <br />drainage or install utilities within the area. <br />Staff Recomendation - <br />TO table the vacation application of 0. The applicant will be advised of the <br />deadlines for the submittal of new information for the 1989 schedule of <br />Planning Commission meetings.
