Exhibit A <br />License No._____ <br />Page 2 <br />III. DOCK LAYOUT (reference Exhibit B attached) <br />Maximum authorized length of main dock 200_teet (see item VI-1C). <br />Docks extending beyond 200 feet and docks encroaching into required side yard setbacks are <br />hereby specifically declared to be illegal non-conforming structures which are not permitted <br />under this license except as noted below. This application does not contain such illegal <br />structures. All such violations are subject to prosecution under Sections 5.42 and 10.41 of <br />the Orono Municipal Code. <br />IV. Marina is authorized for FUEL SALES subject to compliance with the State Fire Code. <br />V. Required number of OFF-STREET PARKING SPACES 68_. <br />All such spaces must be maintained available on the property during all summer season hours <br />of operation. <br />VI. SPECIAL CONDITIONS required for compliance with the ordinances of the City and/or the <br />LMCD. The issuance of this license is subject to full compliance with these conditions. <br />Failure to comply with these conditions is cause for license revocation and/or prosecution by <br />the City. <br />Council acknowledges the following side setback and length variances to LMCD dock <br />regulations allowing the current dock layout per attached Exhibit B (".esignating 77 <br />slips on Maxwell Bay . <br />1. <br />A. <br />B. <br />C. <br />East end, south dock; required 15 ’. allowed 10’ <br />East end, north dock; required 20’. allowed 15 ’ <br />Fuel dock extends 25’ past 200’ limit for safery. <br />Council will continue to deny any future extension of Lakeside .Marina’s commercial <br />use of residential zoned property on Cry.«:tal Bay based on the following findings; <br />A. There is adequate area and lake access provided on the Marina’s lakeshore <br />commercial proper^ on Maxwell Bay. <br />B. The proposeo commercial use in a residential area adversely affects the value <br />and use of surrounding properties <br />C The use of a dock across the road fiom *he commercial operation causes traffic <br />and pedestrian problems. <br />D. Such use would be adverse to ths intent of the Comprehensive Plan and the <br />Zoning Code.
