General Development Plan <br />C - Fleming Trail Plat <br />Review of Application <br />The City is in receipt of written confirmation from the Metropolitan Council that the <br />City ’s Comprehensive Plan Amendment No. 3 has been officially approved. The City of Long <br />Lake’s subdivision and Planned Residential Development known as Fleming Trail is now <br />presented for formal action by the Council. <br />The applicant has fulfilled all conditions of approval as set forth in Resolution No. 3051. <br />Staff has enclosed the Declaration of Covenants that will govern the fti; ire development of Ae <br />property once this property is annexed by Long Lake. The City has been advised that the City <br />of Long Lake will retain ownership of Outlot A, lagoon and Long Lake Creek, and Oullot B, <br />the outlot that provides continued access to the MWCC facility located in exception and fiiture <br />pedestrian access through property to north. As Long Lake will retain ownership of Outlot B, <br />there is no longer a need to execute an access and utility easement over outlot. <br />The vacation of the utility and drainage easements that intersect Lots 1 and 2, Block 2 <br />will be completed when the metro line is relocated within Fleming Trail at the time of <br />development. The MWCC would not release current easement until the line is relocated. <br />The development plan to be attached to the Declaration of Covenants (Exhibit A) of <br />Fleming Trail, will be kept on file at both the City of Orono and Long Lake offices. Members <br />will be happy to know that a large scale, less confusing copy will be provided. <br />Staff recommends approval of the Planned Residential Development and plat of Fleming <br />Trail based on the findings and conditions set forth in the enclosed resolution. <br />7 <br />i <br />■; <br />J <br />I
