These properties are <br />currently under single o%mership. <br />The need to address the creation of Lot 2 results in severe and <br />intense variances. To suggest that Lot 2 is a buildable lot is the one <br />difficult aspect of this subdivision review. Lot 2 should be labeled an <br />outlot, suggesting that it is unbuildable at the time of the platting. <br />This may create a problem for the M.W.C.C. if the lift station can not be <br />built on an outlot. If Lot 2 cannot be labeled an outlot, then the City <br />must ask that special restrictions be filed against the chain of title that <br />would require that it be combined with the adjacent parcels if its use is <br />abandoned by the M.W.C.C. at some time in the future. The M.W.C.C. should <br />respond to the legal issue of the outlot at our meeting on October 3, 1988. <br />In the future, this whole property may be rezoned and replatted to one <br />parcel for combination with the adjacent B-2 properties. The current <br />subdivision will have no negative impact on any proposed future subdivision <br />by the current owner. <br />Staff Recoms»ndation <br />To approve the subdivision application of the M.W.C.C. for the <br />creation of two lots. Lot 1 a residential buildable lot, and Lot 2 <br />(possible Outlot A) deemed unbuildable for residential use and designated <br />by the applicant for exclusive public utility purposes, based on the <br />following conditions: <br />1. Creation of a road outlot, maximum width to meet width of west <br />corridor of Lot 1 at the intersection of County Road 15. <br />2. All access to the newly created parcels must be via the road <br />outlot. <br />3.
