It is recognized that <br />there are several buUt up resi <br />dential areas in the Village which <br />are substandard and overbuilt by <br />the terms of this ordinance. In <br />such areas, building permits m^T <br />be Issued for lots not meeting the <br />minimum requirements ^b- <br />lished by this ordinance. If the <br />Village Council feels that such <br />building will conform to the gen <br />era characteristics of the nei^- <br />^ ,,borhod and will not have an im <br />mediate and specific edvtem <br />^ect upon the public bmlth. <br />Scctioa 1. It is recognized that <br />the enforcement of the minimum <br />l^visions required by this ordl^ <br />ance with respect to 1<^ <br />might be an arbitrary d^ari- <br />vation of a valuable right fromt <br />f*ui owners. Therefore, where • <br />lot which fails to meet the mim- <br />mum standards of this ordi nance <br />is held in a single, separate own- <br />offhip at the time of the pas <br />sage ol this ordinance, Um Coun <br />cil may issue a building permit, <br />provided that there wiU be no <br />Immediau or specific advwse ef <br />fect upon the public health. <br />Scctioa 4. This ordinance su <br />percedes Mid repeals any provi <br />sions in the platting «din^ or <br />zoning ordinances ol the Village <br />which are inconsistent Imrewith, <br />except that provisions of prior <br />ordinances establishing <br />standards than those prescrih« <br />by this ordinance art continued <br />in effect. <br />Section 5. It is recognized that <br />the mtablishment at definite <br />standarda for all lots In the entire <br />Village is impossible, as there <br />may be, in every case, reasMis to <br />relax the standards, or to en <br />force stricter standards. The <br />Council reserves its discretion to <br />increase or decrease the stand <br />ards hereby set for good caus^ <br />whenever the particuUr f^ of <br />the situation convince the Coun <br />cil that the public welfare, and <br />particularly the public health, re <br />quire such modification. <br />Section 6. This ordinance shall <br />be published In the Minneto nka <br />Herald at Wayzata. Minnesota, <br />and fbaii be effective immediate <br />ly upon such publication. <br />Passed by the VUlage Council <br />of the VUage of Orono this ^ <br />day of October, 1959, by a vote <br />of 4 yeas end No nays. <br />H.
