b. <br />c. <br />d. <br />Severe erosion of lakeshore bank <br />Scouring action of waves along west bank of North Arm <br />Severe erosion will eventually impact mature tree and strucniral <br />improvements within lakeshore yard if condition is not remedied. <br />The proposed land alterations within the lakeshore yard will not result in <br />additional hardcover. <br />All tand alterations will be above the 929.4 elevation <br />The Council finds that granting a conditional use permit to allow the land <br />alterations as set forth in the amended plan will not be detrimental to the health, <br />safety or general welfare of the public, would not adversely affect light, air nor <br />pose a fire hazard or other danger to neighboring properties, nor will its use <br />depreciate surrounding property values and that the proposed level of use of the <br />property will be in keeping with the intent and objectives of the Zoning Code and <br />Comprebensive Plan of the City. <br />The City Council fmds that the conditions existing on this prop^ are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring properties; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprebensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Pased upon one or more of the above findings, the Orono City Council hereby <br />giants a variance to Municipal Zoning Code Section 10.53, Subdivision 8 to allow land <br />tlfprafjnn* within the lakeshc»e protected area and grants a conditional use permit per Municipal <br />Zoning Code Section 10.03, Subdivision 9 . • the land alterations involve land movements in <br />of 100 cubic yards.
